BarterMe privacy policy and processing of cookies
- Why should you read this document and what will you find in it?
- This is the privacy policy ("Policy") of barterme.cz, ID No.: 07738803, with registered office at Korunní 2569/108, Vinohrady, 101 00 Praha 10 ("Operator") for the BarterMe platform operated at www.barterme.cz and the BarterMe app for iOS and Android ("BarterMe"). - This Policy describes how we handle the personal information of users of the BarterMe service ("User") and personal information of third parties disclosed to us by Users and how we handle cookies.
- We divide Users into (i) those who submit a request for collaboration with influencers ("Advertiser") and (ii) those who offer to implement such collaboration in the form of creating their own content and publishing it on social media ("Influencer").
- Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, a network identifier or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person ("Personal Data").
- The Operator is the data controller ("Controller") in relation to the Personal Data of Users.
- Users may disclose Personal Data of third parties to the Operator via BarterMe or direct communication. In relation to such Personal Data, the Operator is the data processor ("Processor").
- In handling Personal Data, we comply with Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation, also known as the General Data Protection Regulation ("GDPR"), and Act No. 110/2019 Coll. on the Processing of Personal Data ("PPDA").
- What Personal Data do we process and for what purpose?
- For Influencers, we process the following Personal Data:
- First name, last name, Instagram profile and email address - This data is necessary for the identification of the Influencer, connection with the Advertisers and further communication on BarterMe.
- Date of Birth and Gender - We collect this data when the Influencer connects their Instagram profile or is asked to do so upon registration, in order to filter and sort the campaigns the Influencer may engage in.
- Address - The address must be filled in by the Influencer if they want to participate in a barter campaign so that the Advertiser knows where to send the goods.
- Photo - We obtain a photo when the Instagram profile is connected and display it to the Advertisers for easy identification of the Influencer.
- We process the name, surname, email address and telephone number of the Advertiser, if the Advertiser has provided this information.
- We may also process the following Personal Data as a result of the cookies used: IP addresses of the devices from which you log in and other selected data from system logs, information about the use of our website and information about where you visited our website from, when you visited and left our website, or perhaps how many times you have visited our website, network identifiers assigned by us or services such as Instagram or Facebook, your usernames on these networks and possibly associated emails, other data provided in the context of communication with customer support, other data entered into the application that can lead to your identification (e.g. direct messages).
- The lawful grounds for processing Personal Data are the performance of the contract between the User and the Controller pursuant to Article 6(1)(b) GDPR, the Controller's legitimate interest in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(f) GDPR and consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of the PPDA.
- We do not process Personal Data within the meaning of Article 9 GDPR (sensitive personal data).
- How long do we keep Personal Data?
- The Controller retains Personal Data
- necessary for the exercise of the rights and obligations arising from the contractual relationship between the User and the Controller for the duration of the user account and thereafter for a period of 10 years;
- for marketing purposes only for as long as the consent to the processing of Personal Data is withdrawn, but no longer than 5 years;.
- for archiving purposes in accordance with the relevant legislation, for a maximum period of 10 years.
- After the expiry of the above period, the Controller shall delete the Personal Data.
- To whom may we further disclose the Personal Data?
- Personal Data (within the scope of First Name, Last Name, Your Instagram name and email address, Date of Birth and Gender, Address and Photographs) will be accessed by other Users in order to fulfil the meaning and purpose of BarterMe.
- We may also provide personal data (to the extent of the information collected by cookies) to Google via Google Analytics.
- We may also disclose Personal Data, to the extent necessary, to persons involved in the operation of BarterMe (or providing other services to BarterMe (accounting and other consulting services).
- Personal data may only be transferred within the European Union.
- What rights do you have in relation to Personal Data?
- Subject to the conditions set out in the GDPR, the User has
- The right to access his/her Personal Data in accordance with Article 15 of the GDPR,
- the right to rectification of personal data pursuant to Article 16 of the GDPR, or restriction of processing pursuant to Article 18 of the GDPR,
- the right to erasure of personal data pursuant to Article 17 GDPR,
- the right to object to processing under Article 21 GDPR,
- the right to data portability pursuant to Article 20 GDPR,
- the right to withdraw consent to processing in writing or electronically to the address or email of the Controller.
- Furthermore, the User has the right to lodge a complaint with the Data Protection Authority if he/she believes that his/her right to data protection has been violated.
- How do we handle Personal Data of third parties disclosed by Users?
- By registering to BarterMe, the Advertiser enters into a gratuitous contract with the Processor for the processing of personal data with the following content ("Processing Contract"). Deleting the Advertiser's profile automatically terminates the Processing Contract.
- The Advertiser is entitled to disclose Personal Data of third parties to the Processor via BarterMe or direct communication.
- The Procuring Entity hereby acknowledges that it is itself the data controller in relation to such Third Party Personal Data.
- The Processor shall only contact third parties in connection with a request from the Procuring Entity and as instructed by the Procuring Entity
- The Advertiser agrees to the involvement of sub-processors. In doing so, the Processor undertakes to ensure that sub-processors or persons involved in the processing of Personal Data always meet a high standard of trust.
- How is the Personal Data secured?
- The Controller declares that it has taken all appropriate technical and organisational measures to secure Personal Data.
- The Controller declares that only persons authorised by it have access to the Personal Data.
- The Operator uses cookies on this website, which are used for the purpose of targeting advertising, remembering login details, tracking website traffic and specific events for the purpose of statistics on website visitor behaviour.
- A cookie is a short text file that a visited website stores on your computer or mobile device. It allows a website to record information about your visit, such as your preferred language and other settings. This can make your next visit to the site easier and more productive.
- Cookies are important. Without them, browsing the web would be much more difficult. Cookies take up almost no space on your computer's hard drive and are usually a few kilobytes in size.
- We also use the services of our partners who also use cookies (e.g. Google Analytics, Google Tag Manager, Facebook). These cookies are controlled by third parties and we do not have access to read or write the data stored in them. These are mainly advertising delivery systems or traffic analysis.
- At BarterMe, we may ask for your consent to use cookies. You can withdraw this consent at any time through your browser settings. To disable cookies, you must change your browser settings on the website and refuse cookies. The procedure for rejecting cookies varies depending on the browser you use.

- The Operator has the right to change this Policy at any time. The Operator will announce the change to the Policy on the BarterMe website.
- This Policy will take effect on December 10, 2021.
